School Employment Law

Charter schools need employees in order to operate.  Educating New Mexico’s youth is a big job that requires a variety of faculty and staff skill sets.  Inevitably,  employment law and human resource issues come into play in employing a number of individuals.  General state and federal employment laws and procedures come into play in the charter context;  there are also employment laws and procedures specific to public and charter schools that must be followed. The way that charter schools handle employment law issues can have a direct effect on the schools themselves.

Our attorneys are experienced problem-solvers and provide able assistance to school administration in this complicated environment.  We at Matthews Fox know and understand not only how these rules and regulations function, but how they intersect.  Our attorneys regularly represent the administrators and governing bodies of charter schools in the development of employment policies and employee handbooks, advise with regard to employee background checks and the interviewing and hiring of faculty, and assist with staff and employment contract matters. We also represent charter school clients with employment-related school operations, including the teacher and administrator evaluation process, employee discipline matters, and termination and discharge proceedings.

In addition, Matthews Fox attorneys have experience handling matters relating to civil rights, Equal Employment Opportunity,  Title VII,  age discrimination, pregnancy discrimination, Americans with Disabilities Act, and Equal Pay Act matters. We also advise on and handle issues relating to employee compensation and leave under the Fair Labor Standards Act and the Family Medical Leave Act.

Although operating a charter school and dealing with related employment law and human resources issues can be difficult, the job can be made considerably easier by retaining an attorney.  We are here to help. If you are experiencing a legal issue relating to a New Mexico charter school, contact our office by calling (505) 473-3020 for a consultation.
